Do we have to display labor law posters?

Nearly all churches with W-2 employees are required to display one or more Workplace Posters. Federal Posters are available for free from the US Department of Labor (DOL).  The DOL has a helpful elaws Poster Advisor to assist with determining your legal requirements under Federal Law. Church leaders and administrators should also check state and local requirements as many jurisdictions have additional requirements.

The Fair Labor Standards Act (FLSA) requires that every employer with employees subject to the Fair Labor Standards Act's minimum wage provisions must post the Fair Labor Standards Act (FLSA) Minimum Wage Poster. Any church with W-2 employees is likely subject to FLSA.

The Occupational Safety and Health (OSH) Act applies to any church with secular (non-ministerial) employees. Most Congregations must display the Federal OSHA poster, however employers in states with an OSHA-approved state plan may be required to post a state version of the OSHA poster.

The Equal Opportunity Employment Commission (EEOC) requires all employers to display the "Know Your Rights" poster.

This list is not exhaustive and congregational leaders should check with appropriate regulatory agencies to insure that they are in compliance with all local requirements.
